01 About these terms

These Terms and Conditions govern all services purchased through EPCinEnglish.be and constitute a binding agreement between you ("the Client") and enerBLD BV ("enerBLD", "we", "us").

By completing a purchase on this website, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, do not proceed with a purchase.

These terms apply to all service tiers offered through EPCinEnglish.be. References to "services" mean the specific tier purchased by the Client at the time of order.

02 Services

EPCinEnglish.be offers the following service tiers:

Tier 2 Owner's Decision Report Everything in Tier 1, plus a 30-minute video consultation. Includes contractor quote review (up to two quotes, submitted within 90 days of purchase) and subsidy eligibility review. €395
Important: enerBLD's services constitute independent professional advisory opinion based on review of documents provided by the Client. enerBLD does not issue, modify, or certify Belgian Energy Performance Certificates (EPC). Our services do not constitute formal certification of regulatory compliance under Belgian energy law. The Client remains solely responsible for decisions made on the basis of enerBLD's advice.

Contractor quote review: Tier 2 includes review of up to two contractor quotes submitted within 90 days of purchase. Quotes submitted after the 90-day window are not included and may be subject to additional fees at enerBLD's standard rate of €95/hour.

Subsidy eligibility review: enerBLD will advise on which subsidies and financial incentives may apply to the Client's situation based on information provided. This constitutes advisory opinion only — enerBLD does not submit applications on the Client's behalf or guarantee subsidy outcomes.

03 Payment

Payment is due in full at the time of order, prior to delivery of services. All payments are processed securely via Stripe.

All fees are stated inclusive of VAT at the applicable rate. A receipt will be provided by Stripe upon payment.

Business clients: If you are purchasing on behalf of a business and provide a valid EU VAT number at checkout, the reverse charge mechanism applies. In this case, enerBLD will invoice without VAT and you are responsible for accounting for VAT in your own jurisdiction under the reverse charge mechanism.

For Tier 2 services, work will not commence until payment has been received in full and all required documents have been submitted.

04 Cancellation and right of withdrawal

Under EU consumer law (Directive 2011/83/EU), consumers ordinarily have a 14-day right of withdrawal from distance contracts.

However, by completing payment and requesting that enerBLD commence work immediately, you expressly acknowledge and agree that:

If enerBLD has not yet commenced work on your order, you may cancel and receive a full refund by contacting info@epcinenglish.be within 14 days of payment. Work is deemed to have commenced once enerBLD has begun review of the documents submitted by the Client.

05 Client obligations

To enable enerBLD to deliver the service, the Client agrees to:

06 Delivery

Tier 1: The Owner's EPC Review will be delivered by email within 48 hours of receipt of the Client's EPC document.

Tier 2: The written report will be delivered within 5 business days of receipt of all required documents. The video consultation will be scheduled at a mutually agreed time following delivery of the report.

Delivery timelines are indicative and may be affected by factors outside enerBLD's control, including delays in document submission by the Client. enerBLD will communicate any delays promptly.

07 Limitation of liability

enerBLD's services constitute independent professional advisory opinion. enerBLD does not guarantee specific EPC outcomes, renovation costs, contractor performance, or subsidy approvals. The Client remains solely responsible for all decisions made on the basis of enerBLD's advice.

enerBLD's total liability to the Client shall not exceed the fees paid by the Client for the specific service in question. enerBLD shall not be liable for indirect, consequential, or incidental losses arising from reliance on the services provided.

Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury caused by negligence.

08 Confidentiality and data

enerBLD treats all documents and information provided by the Client as confidential. Property documents, including EPC certificates, sale documents, and property addresses, will be used solely to deliver the agreed service and will not be shared with third parties except as required by law.

enerBLD may retain anonymised data derived from EPC reports for the purpose of improving its services, provided that no personally identifiable information or property addresses are retained in association with such data.

09 Dispute resolution

In the event of a complaint or dispute, please contact us first at info@epcinenglish.be. We will make every reasonable effort to resolve complaints promptly and fairly.

If a dispute cannot be resolved informally within 30 days, either Party may refer the matter to mediation before initiating legal proceedings.

Clients who are consumers (natural persons acting outside their professional capacity) also have access to the EU Online Dispute Resolution platform:

enerBLD is not obligated to participate in alternative dispute resolution proceedings but will consider each request in good faith.

10 Governing law

These Terms and Conditions are governed by the laws of the Netherlands. Any disputes not resolved through the process described in Section 9 shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

Nothing in this clause affects the statutory rights of consumers under mandatory consumer protection laws applicable in their country of residence.

11 General

If any provision of these Terms is found to be void or unenforceable, the remaining provisions continue in full force. Any void provision shall be replaced by one that most closely reflects the original intent.

enerBLD reserves the right to update these Terms and Conditions. The version in effect at the time of purchase applies to that order. Updated terms will be posted at this URL with a revised date.

enerBLD acts as an independent contractor. Nothing in these Terms creates an employment relationship, partnership, or joint venture.
